Axiom Exergy Inc. (“Axiom," “we,” “us” and “our”) uses its proprietary Refrigeration Battery® platform to deliver various turnkey managed services to its customers. This platform is a retrofit that enables medium-temperature refrigeration systems to “store cooling” for later use, so that compressors and condensers can be shut off completely without interruptions to cooling services, and includes a cloud-based, enterprise-level monitoring/control portal that leverages big data analytics to help monitor and optimize refrigeration system performance (collectively, the “Hosted Service”).
The Hosted Service includes an online portal available at portal.axiomexergy.com (the “Site”) through which your authorized employees and agents may choose to, among other things, monitor and observe the performance of the Hosted Service with respect to your facility(ies) and communicate with us (the “Portal”).
1. Types Of Information We Collect
Axiom may collect two types of information from users of our Hosted Service and Portal: “Personal Information” which is information that can be used to identify you (such as name or e-mail address) and “Aggregate Information” which is information that cannot be used to identify you (such as frequency of visits to the Portal, etc.).
2. Personal Information Collected
Axiom collects Personal Information that is voluntarily provided, including when a user of our Hosted Services or Portal provides information such as, for example, name or email address. We make no representation or warranty as to the privacy policies of any third parties, including the providers of third party applications.
We use Personal Information to provide the functionality offered by the Hosted Services and the Portal to our users, to improve our users’ experience on the Hosted Services and the Portal, and to communicate with them about information that they request.
3. Aggregate Information Collected
Aggregate Information is information that does not identify you. Aggregate Information may be collected when you use the Hosted Services or interact with the Portal or Hosted Services independent of any information you voluntarily enter. For example, when you visit our Portal, some information is automatically collected. Such information could include your computer's Internet Protocol (“IP”) address and operating system, device identifier numbers, and the time and date of your visit. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time. Axiom may collect, use, store, and transfer Aggregate Information without restriction.
Use of “Cookies”:
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser to help us identify you when you come to our website. You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies you may be unable to use those aspects of our Site which require registration in order to participate. Axiom may use analytics analyze certain traffic relevant to the use of the Hosted Services and the usage of the Portal.
4. Sharing of Personal Information with Third Parties
Axiom may transfer Personal Information to third parties for the purpose of providing the Services. These third party service providers are not authorized to retain, share, store or use the Personal Information for any purposes other than to provide the services they have been hired to provide. Axiom does not sell, trade or otherwise share Personal Information with third parties for the marketing purposes of the third party.
Axiom may also elect to transfer your personal information to third parties under special circumstances to: (i) to comply with a legal requirement, judicial proceeding, court order, or legal process served on Axiom, (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Axiom; (iv) when we believe it is necessary to protect the rights, property, or safety of Axiom or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Axiom.

We take appropriate security measures to protect against unauthorized access, alteration, disclosure or destruction of Personal Information. These measures include internal reviews of our data collection, storage and processing practices, and security measures. We restrict access to Personal Information to Axiom employees, service providers and agents who need this information to operate, develop or improve our Services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Please be aware that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security.
6. Integrity of Your Data
Axiom processes Personal Information only for the purposes for which it was collected and in accordance with this Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the Personal Information needed to provide or improve our services. We take reasonable steps to ensure that the Personal Information we process is accurate, complete, and current, but we depend on our users to update or correct their Personal Information whenever necessary.

Our Hosted Services and Portal are not directed to those under the age of 18 and we will not request personally identifiable information from anyone we know to be under the age of 18. If we become aware that an individual under the age of 13 has provided personally identifiable information, we will immediately remove the individual’s personally identifiable information from our files.
